Terms and Conditions

1. Acceptance

By downloading and using the TC App (the “Application”) developed by Donald Lewis (the “Service Provider”), you agree to be bound by these Terms and Conditions (“Terms”) and the Privacy Policy (collectively, the “Agreements”). If you disagree with any part of the Agreements, then you may not download or use the Application.

2. Use of the Application

The Application is provided for your use “AS IS” and free of charge. You are granted a non-exclusive, non-transferable license to use the Application in accordance with these Terms.

3. User Conduct

You agree to use the Application in a lawful and respectful manner. You will not:

• Violate any applicable laws or regulations.
• Infringe on the rights of others, including intellectual property rights.
• Transmit any harmful or malicious content, such as viruses or malware.
• Disrupt or interfere with the Application or its servers.
• Collect or harvest any data from the Application without authorization.

4. Termination

The Service Provider reserves the right, at its sole discretion, to terminate your access to the Application and/or suspend or terminate your account for any reason, including, but not limited to, a violation of these Terms.

5. Intellectual Property

The Application and all intellectual property rights associated with it, including copyrights, trademarks, and patents, are the property of the Service Provider or its licensors. You are granted a limited license to use the Application, but you do not acquire any ownership rights in it.

6. Disclaimer of Warranties

THE APPLICATION IS PROVIDED “AS IS” AND WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. THE SERVICE PROVIDER DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE SERVICE PROVIDER DOES NOT WARRANT THAT THE APPLICATION WILL FUNCTION UNINTERRUPTED, ERROR-FREE, OR VIRUS-FREE.  

7. Limitation of Liability

THE SERVICE PROVIDER SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APPLICATION, INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

8. Indemnification

You agree to indemnify and hold harmless the Service Provider, its officers, directors, employees, agents, and licensors from and against any and all claims, losses, damages, liabilities, costs, and expenses (including attorneys’ fees) arising out of or related to your use of the Application.  

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Utah, United States.

10. Entire Agreement

These Terms constitute the entire agreement between you and the Service Provider regarding your use of the Application.

11. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.  

12. Changes to the Terms

The Service Provider reserves the right to update these Terms at any time. You are advised to consult this page regularly for any changes, as continued use of the Application is deemed your approval of all changes.
